Abstract

This paper attempts to find an explanation regarding the relationship between the fundamental rights recognized in constitutional texts and their concrete effectiveness in each specific society, based on the political-ideological model of institutional and legal organization of the State. That is, the type of regulation of these fundamental rights and their guarantees (primary and secondary), acquires possibilities of effectiveness from the type of guiding principle of the entire institutional political legal system, that is, the existence of legal guarantees against inequalities. It will also depend on the impact on the constitutional system of the principle of subsidiarity or the principle of solidarity.
