In accordance with our National Constitution, the Legislative Power is formed by “a Congress composed of two Chambers, one
of Deputies of the Nation and the other of Senators of the provinces and the city of Buenos Aires” (Art. 44). Deputies should be proportionally elected taking into account the number of inhabitants of each province according to the last census. However, the current composition of the Chamber of Deputies is totally anachronic because the proportionality that should exist between the inhabitants of each district and the deputies elected by them is not respected. This phenomenon is known as malapportionment and was analyzed by the provincial legislator Aurelio García Elorrio in 2016, when he promoted an action of protection against the National State (Chamber of Deputies) claiming that the Lower Chamber be ordered to pass a law that would update the number of deputies elected by each province according to the last population census (2010)
