Abstract

This paper considers whether it is constitutionally possible for the Chamber of Senators to meet through digital means -where the identification and will of legislators is guaranteed- to legislate on tax matters, due to the situation of institutional gravity generated by COVID19, attentive to than art. 30 of its Regulations establishes that the senators constitute the Chamber in the room of its sessions? In the formulation of the constitutional question, the recent history of Argentina is especially taken into account in terms of the existence of maneuvers of all kinds -including judicial ones- tending to prevent the application of laws that affect the interests of economic groups. With this work it is intended to analyze the interposed proposal, the ruling of the CSJN, and suggest a possible institutional solution according to reasonableness guidelines consistent with the National Constitution and the jurisprudential precedents of the highest federal court.
